Terms of Service
Effective Date:
Welcome to Plumber Pro Dallas (“PPD,” “we,”
“our,” or “us”). These Terms of Service
(“Terms”) govern your access to and use of our website, online
scheduling, estimates, and all plumbing and related services we provide at homes and
businesses in and around Dallas, Texas (collectively, the “Services”).
By scheduling, authorizing, or paying for any Service, you agree to these Terms.
1) Scope of Services
- We provide residential and commercial plumbing services, including inspections,
diagnostics, repairs, installations, maintenance, and emergency response.
- Services are performed by licensed professionals in accordance with applicable codes
and industry standards.
- We reserve the right to decline work that is unsafe, unlawful, or beyond our
capabilities/equipment at the time of service.
2) Estimates & Pricing
- Estimates: Written or digital estimates are good-faith
approximations based on visible conditions at the time. Hidden conditions (e.g.,
concealed leaks, corroded pipes, inaccessible valves) may require additional work
and cost.
- Flat-Rate / Time & Materials: Depending on the job, we may
price flat-rate or time-and-materials. Your estimate or work order will specify
which applies.
- Taxes & Fees: Prices may exclude permit fees, disposal fees,
after-hours charges, and applicable taxes unless noted.
- Approval: We will not begin billable work without your
authorization (written, digital, or recorded verbal).
3) Scheduling, Arrival & Access
- Appointment windows are estimates; traffic, emergencies, or preceding jobs can
affect timing. We’ll communicate delays when possible.
- You must ensure safe, unobstructed access to work areas, crawlspaces, attics,
utility rooms, and shutoff valves.
- An adult (18+) must be present to authorize work unless otherwise arranged in
writing.
4) Customer Responsibilities
- Disclose known issues, past repairs, and any hazardous conditions (e.g., asbestos,
mold, contaminated water, gas leaks).
- Secure pets, personal items, and valuables. Remove items that block access where
reasonably possible.
- Provide accurate contact, billing, and site information.
5) Materials, Parts & Warranties
- Materials: We use professional-grade parts and materials.
Equivalent substitutions may be used as needed to maintain quality and timelines.
- Manufacturer Warranties: Products we supply are covered by the
manufacturer’s warranty, if any. We’ll help you obtain warranty service where
applicable.
- Workmanship Warranty: Our standard workmanship warranty is
1 year from completion on our labor for the specific
repair/installation stated on the invoice, unless otherwise noted. Damage from
misuse, neglect, freezing, power surges, acts of God, or third parties is excluded.
- Customer-supplied parts are installed “as is” with no warranty from
us and may incur additional labor charges if incompatible or defective.
6) Changes & Unforeseen Conditions
- If new findings arise (e.g., brittle piping, code violations, collapsed lines),
we’ll discuss options and pricing revisions before proceeding.
- Unauthorized changes to our work by others void our workmanship warranty.
7) Payment Terms
- Due at Service: Payment is typically due upon completion. Larger
projects may require deposits and progress payments.
- Methods: We accept common payment methods as listed on your invoice
or the website.
- Late/Collections: Past-due balances may accrue late fees, interest
as allowed by law, and reasonable collection costs, including attorney’s fees.
- Chargebacks: Initiating a chargeback without contacting us to
resolve a bona fide dispute may incur fees and suspension of services.
8) Cancellations & Rescheduling
- For standard appointments, please notify us at least 24 hours in
advance to cancel or reschedule.
- Emergency/After-Hours: Dispatch or trip fees may be non-refundable
once a technician is en route.
- Missed appointments or inaccessible sites may incur a service call charge.
9) Permits, Code & Inspections
- Where required, we can obtain permits and coordinate inspections. Permit and
inspection fees are billed to you.
- We perform work to current code. Pre-existing conditions may require upgrades to
pass inspection; related costs are the customer’s responsibility unless otherwise
stated.
10) Property Protection & Limitations
- We take reasonable steps to protect your property (drop cloths, shoe covers,
cleanup). Minor scuffs or dust can occur with construction work.
- We are not responsible for pre-existing conditions or resulting damage (e.g.,
fragile tile, deteriorated piping, old shutoff valves that fail when operated).
- Customer is responsible for clearing access and protecting sensitive
items/furnishings not reasonably within our control.
11) Health & Safety
- If hazardous materials (e.g., asbestos, mold, sewage contamination, gas leaks) are
suspected, work may pause until conditions are remediated.
- We comply with applicable OSHA and local safety rules; we may refuse unsafe work
conditions.
12) Photos & Documentation
- We may document job conditions (before/after photos, videos) for quality control,
training, permits, or warranty purposes.
- With your consent, we may use non-identifying images for marketing (no addresses,
names, or personal info).
13) Privacy
- We collect only the information needed to schedule, perform, and bill for Services.
See our Privacy Policy for details on how we handle your data.
14) Disclaimers & Limitation of Liability
- Except as expressly stated, the Services are provided “as is” and “as available.” To
the maximum extent permitted by law, we disclaim implied warranties of
merchantability, fitness for a particular purpose, and non-infringement.
- Limitation: Our total liability for claims arising out of or
related to the Services is limited to the amount you paid for the specific Service
giving rise to the claim.
- In no event are we liable for indirect, incidental, consequential, special, or
punitive damages (e.g., lost profits, business interruption, secondary damage from
pre-existing defects).
15) Dispute Resolution
- Good-Faith Resolution: You agree to first contact us to attempt to
resolve any dispute informally.
- Arbitration: If we cannot resolve a dispute within 30 days, it
shall be resolved by binding arbitration on an individual basis in Dallas County,
Texas, under the rules of the American Arbitration Association. You and we waive
class actions and jury trials to the fullest extent permitted by law.
- Small Claims: Either party may bring qualifying claims in small
claims court in Dallas County instead of arbitration.
16) Governing Law & Venue
These Terms are governed by the laws of the State of Texas, without regard to its
conflict-of-law principles. Venue for any permitted court action lies exclusively in
Dallas County, Texas.
17) Severability & Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions remain
in full force. These Terms, together with any signed estimate/work order, constitute the
entire agreement regarding the Services and supersede prior discussions.
18) Changes to Terms
We may update these Terms from time to time. The “Effective Date” will reflect the latest
revision. Continued use of our Services after changes constitutes acceptance.
